You must agree and adhere to the following Terms and Conditions at the time of using this website for downloading and uploading the broadband speed test.

1. Service Usage Restrictions:

The technical compatibility of the speed test provided in this website is strictly limited to fibre broadband connections with speeds of 2.5Gbps or below. Any broadband services exceeding this speed (including but not limited to 5Gbps and 10Gbps specifications) are outside the supported scope of this speed test. If you are using fibre broadband services with speed above 2.5Gbps, you may choose to use the Speedtest.net application or other test tools for speed testing. You may be subject to their terms and conditions, HKBN will not be responsible for such test tools, mobile applications, the accuracy of the results or other legal liabilities.

2. Testing Platform:

The speed test provided in this website is to provide user with a single platform for reference only. You understand that this speed test refers to your network connected to the website hosted in the server of speedtest.hkbn.com.hk for uploading or downloading speed test while the test results are for reference only. Except for the purpose stated above, you are not allow to use this website and/or test results for any other purposes. Hong Kong Broadband Network Limited (“HKBN”) does not guarantee in formal representations and expressions on this website, this speed test and the test results and shall not be responsible for any other related legal obligations, disputes, grievances or complaints.

3. Correct Use:

If HKBN discovers that you use the services provided in this website to perform any other illegal or intrusive behaviour against third party, HKBN has the right to forward the record of your use of the services to the relevant law enforcement department. HKBN will store your record of use of services in this website separately. Any improper or illegal use or HKBN suspected improper or illegal use of this website will be stored in the files of HKBN. HKBN has the right to transfer the relevant records to relevant law enforcement department.

4. Personal Information Collection Statement:

HKBN will record test results and related information of this speed test (including but not limited to the name network service provider, upload and download speed, IP address and location, testing date, operating system version, latency, browser name and jitter etc), for the compilation of statistical reports and the diagnosis of problems with or concerning this speed test system, but will not collect any identifiable data from you . 5. Responsibilities:

You acknowledge and agree that HKBN will not accept any responsibilities for the following matters: (i) any loss of data on your computer’s pre-installed software and/or hardware for any loss or damage caused; (ii) any error, interference or computer virus of your computer system which leads to you or any third party suffered from any direct or indirect or special revenue, profits, goodwill or any consequential economic loss or lose of any other liability claims; (iii) your violation of these terms and conditions caused by any action, liability, costs, claims, losses, damages, legal or other expenses or compensation.

6. You understand and accept to make full compensation to HKBN and indemnify HKBN from any of your violation of these terms and conditions either directly or indirectly that HKBN suffer or incur any liability, claims, losses, damages and expenses etc.

7. Modification:

HKBN reserves the right to amend these and relevant terms and conditions at any time without prior notice and/or related reasons. In case of any dispute, the decision of HKBN shall be final and conclusive.

8. Copyright and other intellectual property rights: The copyright of this website is owned by HKBN; and HKBN shall retain and own any part of this website or the content of all intellectual property rights. No personnel shall copy any part or content of this website.

9. Violation:

You ensure and guarantee that any downloading and uploading speed test at this website will not violate, infringe or damage any of the copyright owner, any person or entity of the legal rights (including but not limited to copyright, trademark or service mark infringement, counterfeiting, slander or goodwill damage), any rights and any applicable laws and regulations. You also promise to compensate HKBN and bear all the violations arising from or related to any claims, actions, and/or due to the violations arising from all liabilities, losses, costs, legal fees, professional fees, expenses and other costs of any damage.

10. General terms and conditions:

You are deemed to accept and agree to comply with and be bounded by these terms and conditions of use by using this website and/or this speed test system.
